Appeals Court Upholds Trump Administration's Nationwide Fast-Track Deportation Expansion

Federal Appeals Court Backs Expanded Expedited Removal Policy

A federal appeals court has given the Trump administration the green light to implement a nationwide expansion of its expedited deportation process. This ruling enables the swift removal of immigrants, even those residing significant distances from the U.S. border.

Overturning a Prior Injunction

On Tuesday, a three-judge panel of the U.S. Court of Appeals for the District of Columbia Circuit voted 2-1 to reverse an earlier decision. In August 2025, a lower court judge had issued an injunction, preventing the U.S. Department of Homeland Security (DHS) from extending the criteria for expedited removal.

Nationwide Application of Expedited Removal

For almost 30 years, the expedited removal process has primarily been utilized for migrants apprehended directly at the border, allowing for their rapid repatriation. The recent appeals court decision now allows the DHS to apply this accelerated deportation procedure more broadly, impacting non-citizens across the country, regardless of their proximity to border regions.
