Court Finds Policies 'Arbitrary and Capricious'
A federal judge in California has invalidated nationwide policies from the previous Trump administration that broadened the scope of arrests at immigration courthouses and extended the period for detaining noncitizens in short-term facilities. The court determined that the actions taken by US Immigration and Customs Enforcement (ICE) and another government entity were "arbitrary and capricious."
Details of the Ruling
US District Judge P. Casey Pitts, presiding over the Northern District of California, issued the ruling on Tuesday. His decision specifically vacated ICE policies that had previously lifted restrictions on arrests within immigration courthouses. Additionally, the judge struck down the policy allowing detainees to be held in short-term cells for up to 72 hours. A similar policy from the US Department of Justice's Executive Office for Immigration Review, which also removed limits on courthouse arrests, was similarly vacated.
