NHS Trust Pays £187k in Damages Over Transgender Changing Room Dispute

Employment Tribunal Rules Against NHS Trust

County Durham and Darlington NHS Foundation Trust has disbursed £187,000 in compensation after an employment tribunal determined that it subjected seven nurses to harassment. The harassment stemmed from the trust's requirement for these nurses to share a changing facility with a transgender woman.

Judges concluded that the trust fostered a "hostile environment" for the nurses. Their objections arose from Rose Henderson, who was assigned male at birth and identifies as a woman, utilizing single-sex changing rooms.

Nurses' Concerns and Trust's Response

Bethany Hutchison, one of the claimants and president of the Darlington Nursing Union, stated that the nurses voiced their concerns to safeguard women's privacy but were met with "pressure and intimidation."

Steve Russell, CEO of the trust, acknowledged that the organization's approach should have been different and expressed regret for the "impact this has had on the colleagues involved." Ms. Hutchison viewed the tribunal's outcome as a "vindication of our stand for dignity, privacy, and common sense," hoping it would prevent similar situations where women feel unsafe for speaking out.

Trust's Apology and Policy Changes

Following the judgment, the trust collaborated with the nurses to establish a remedy agreement. As part of this, the trust recognized the tribunal's findings and is issuing a formal apology to the nurses. It also committed to ensuring the availability of unisex facilities across its hospital sites and to ongoing policy reviews.

Mr. Russell confirmed that updated guidance has been issued and unisex facilities developed to ensure that single-sex facilities are utilized based on biological sex. He added that while this aligns with the judgment, the trust aims to further enhance changing facilities for all staff members.

Christian Concern, which provided support to the nurses during their legal challenge, noted that the £187,000 payout does not encompass legal costs, which are pending a separate hearing. Previously, it was disclosed that the trust had incurred £603,000 in its own legal expenses for the case.
