Decades-Old Case Concludes with Manslaughter Conviction
Janice Nix, 67, has received a 12-year prison sentence following her conviction for the manslaughter of her five-year-old stepdaughter, Andrea Bernard, in 1978. The tragic incident, which occurred nearly 50 years ago in Thornton Heath, south London, involved Nix forcing the child into scalding hot water.
Details of the Incident and Subsequent Death
Andrea Bernard suffered extensive burns covering half of her body and succumbed to her injuries five weeks later, on July 13, 1978, while in hospital. For decades, Andrea's death was officially considered an accident. However, the case was reopened after Andrea's older brother, Desmond Bernard, approached the police in 2022, prompting a new investigation.
Court Proceedings and Sentencing
During the trial at Isleworth Crown Court, the jury found Nix guilty of manslaughter. Judge Justice Lavender, in delivering the sentence, stated, "I'm sure that you ran the bath, you knew how hot it was... You heard her screams." The judge further emphasized, "At the very least the risk ought to have been obvious to you."
Nix, a resident of Clapham, was also convicted of cruelty towards Desmond Bernard, who was between the ages of seven and nine, from October 1975 to June 1978.
Victim Impact and Sentence Terms
Desmond Bernard, now 56, delivered a powerful victim impact statement in court, directly addressing Nix. He tearfully conveyed, "Your actions robbed me of my sister, and my sister of her life." While he spoke, Nix was observed shaking her head and appearing to mouth words. The judge ruled that Nix will be required to serve two-thirds of her 12-year sentence before becoming eligible for release on licence.
